By accessing or using any service provided by EZ Website Builder, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with these terms, you may not use the service.
2. Services Overview
EZ Website Builder offers three website-building plans: WordPress Plan, SitePad Plan, and Softaculous Plan. Each plan includes website-building software, LiteSpeed Technology, cutting-edge servers for fast website loading speeds, and a variety of tools and features for creating and managing websites.

3. Use of Services
You are responsible for all content posted and activity that occurs under your account. You agree to:
Not use the service for illegal or unauthorized purposes.
Not exploit the service, including by hacking, spamming, or using bots.
Abide by all local, national, and international laws and regulations.
Violation of any of these conditions may result in immediate termination of your account.
4. Intellectual Property
All content provided by EZ Website Builder, including but not limited to software, templates, and media files, is the intellectual property of EZ Website Builder. You are granted a limited, non-exclusive, non-transferable license to use the materials solely in connection with your website-building activities.
You are responsible for ensuring that any content you upload does not infringe upon the intellectual property rights of others.
5. Account Registration
To access our services, you must register for an account. You agree to provide accurate and current information and to update your information if it changes. You are responsible for maintaining the security of your account and for all activities that occur under your account.
6. Payment Terms
Trial Period: You can opt for a $1 for 3 months trial for any of our plans. After the trial period, regular charges will apply.
Annual Plan: You may choose to pay $35 per year for continuous access to your chosen plan.
All fees are non-refundable except where stated in the Money-Back Guarantee (see Section 7). EZ Website Builder reserves the right to modify fees at any time but will provide 30 days' notice before any price changes go into effect.
7. 45-Day Money-Back Guarantee
We offer a 45-day Money-Back Guarantee for all our web builders. If you are not satisfied with our services, you may request a full refund within 45 days from the date of your initial purchase. Refunds requested after this period will not be honored.
8. Cancellation and Termination
You may cancel your account at any time by contacting us through your account dashboard or via email. Upon cancellation, all content associated with your account may be permanently deleted. EZ Website Builder is not responsible for any data loss that may result from the cancellation.
We reserve the right to suspend or terminate your account for any violation of these Terms of Service without notice.
9. Uptime Guarantee
We aim to provide an uptime of 99.9% for all websites hosted on our servers. While we strive for excellent performance, EZ Website Builder is not responsible for service interruptions caused by factors beyond our control, including but not limited to:
Acts of nature
System maintenance
Network outages
Third-party service issues
10. Limitation of Liability
To the fullest extent permitted by law, EZ Website Builder and its affiliates, employees, and partners shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to data loss, loss of revenue, or damages resulting from the use or inability to use our services.
11. Indemnification
You agree to indemnify and hold harmless EZ Website Builder, its affiliates, employees, and partners from any claim or demand, including reasonable attorneys' fees, arising from your use of the service or violation of these Terms of Service.
12. Changes to Terms
EZ Website Builder reserves the right to update or modify these Terms of Service at any time. We will notify you of any significant changes via email or through your account dashboard. Your continued use of the service after such changes constitutes acceptance of the revised terms.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the state of Arizona, without regard to its conflict of law principles.
